REACH stakeholders concerned over varying fines
Fines for infringements of the EU’s REACH regulation vary widely across member states and some may not be high enough, according to a European Commission report presented to the European Chemical Agency’s third stakeholder day on Monday.
Presenting the preliminary findings, Bartlomiej Balcerzyk of the commission’s environment department said that countries such as the UK and Poland set very high sanctions, while others like Austria and Romania set them low.
Because the volume of production does not factor into any country’s regime, the lowest fines may not deter large producers. Infringement carries criminal penalties in only about half of member states.
Industry representatives remain concerned about fee structures. Erwin Annys, REACH director for chemicals industry group CEFIC, said a distinction should be made between deliberate violations and small errors.
ECHA executive director Geert Dancet said that while the agency does not have authority over REACH enforcement, its enforcement forum can encourage harmonisation. The preliminary findings are due to be presented to the forum later this week. The full report will not be made public for some time.
Mr Dancet also tried to sooth stakeholder concerns about the performance of ECHA’s IT system for submitting dossiers. He said an online system to check technical completeness will be available by Christmas. There will be no major changes to the REACH-IT system in 2010, he added. ECHA also announced the launch of a new webpage for the regulation on classification, labelling and packaging (CLP).
*Meanwhile ECHA’s member state committee has agreed to add 15 new substances of very high concern (SVHC) to the REACH candidate list. The agency will recommend which chemicals should then be prioritised for authorisation in the second half of 2010.
